These Terms govern your access to and use of our website, including the purchase, licensing, and use of digital house plans, CAD files, and related content (“Plans”). By accessing or using the Website, you agree to comply with these Terms. We reserve the right to modify, update, or change these Terms at any time at our sole discretion. It is your responsibility to review these Terms periodically for any changes. Your continued use of our Services after modifications are posted constitutes acceptance of the updated Terms. If any changes are made to these Terms that materially impact your rights, we will notify you through appropriate means, including but not limited to email, website notifications, or direct messages. However, it is ultimately your responsibility to stay informed about our Terms and policies.

2. USE OF OUR WEBSITE

2.1. Eligibility

To lawfully acknowledge and agree to these Terms, you must be of legal age (18 years or older) in your jurisdiction to enter into binding contracts. By creating an account, purchasing plans, or otherwise accessing or using the website, you expressly affirm and warrant that you:

A. Meet the minimum age requirement specified above;
B. Have the legal capacity to accept these Terms and comply with all applicable laws;
C. Understand that your actions constitute a binding legal agreement with TheHousePlanSource.com.

2.2. Account Registration

To purchase plans or access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for any activity on your account. You agree to notify us immediately of any unauthorized use of your account or any security breach.

2.3. Prohibited Activities

You agree not to:

A. Violate any laws or regulations.
B. Use our website for fraudulent, misleading, or unlawful purposes.
C. Copy, distribute, or modify any content without permission.
D. Interfere with the security, integrity, or functionality of the website.
E. Use automated systems, bots, or scripts to access or manipulate the website.
F. Submit false or misleading information or impersonate another individual or entity

The website is intended for users aged 18+. Minors may only use the website under parental supervision. By using the website, you warrant legal capacity to enter into binding agreements

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Ownership of Content

All content featured on our website, including but not limited to, architectural plans, blueprints, CAD files, and 3D models (“Plans”) as well as text, descriptions, and specifications, graphics, illustrations, and renderings, logos, branding, and website design or any other downloadable or digital materials is the exclusive property of The House Plan Source and its authorized licensors. This content is protected under USA’s and international copyright laws, trademark laws, trade secret protections, and other intellectual property (IP) statutes.

5.2 Copyright Protection & Notices

A. Any digital or physical copy of a Plan obtained through purchase or download is presumed to be a licensed copy and must be treated as such under these terms.
B. Altering, obscuring, or falsifying any copyrighted plan is strictly prohibited and constitutes a violation of federal copyright law (17 U.S.C. § 1202).
C. Unauthorized reproduction, distribution, or modification of Plans may result in legal action, including injunctions, statutory damages (up to $150,000 per violation under the DMCA), and recovery of attorney fees.

6. LIMITED LICENSE AGREEMENT

6.1 Grant of License

I. No resale, redistribution, or sharing of digital or printed Plans with third parties (including other builders, developers, or online platforms).
II. No derivative works or modifications without prior written consent from The House Plan Source.
III. No commercial replication (e.g., building multiple homes from a single Plan purchase).
IV. No removal of watermarks, copyright stamps, or proprietary markings.

6.2 Retention of Ownership

A. The House Plan Source retains full and exclusive ownership of all Plans, including copyrights, design rights, and any modifications or derivative works.
B. Purchasing a Plan does not transfer ownership. Only a limited license as outlined above is provided to the client.

6.3 Enforcement and Violations

Unauthorized use (including but not limited to copyright infringement, license violations, or fraudulent claims of ownership) will result in:

I. Immediate termination of license rights.
II. Legal action, including DMCA takedowns, civil litigation, and pursuit of statutory damages.
III. Possible blacklisting from future purchases on The House Plan Source’s website.

7. ADDITIONAL USER OBLIGATIONS

7.1.Third-Party Use and Accountability

The Client/User acknowledges and agrees that, when engaging third-party professionals (including but not limited to architects, engineers, contractors, or builders) in connection with the purchased Plans, the Buyer assumes full responsibility for ensuring such parties:

A. Are made aware of and agree to comply with all license terms and restrictions outlined in this Agreement
B. Understand the limited, single-use nature of the license granted
C. Do not reproduce, modify, or distribute the Plans beyond what is expressly permitted
D. Return or destroy all copies of the Plans upon project completion

7.1.1. Third Party Usage Disclaimer

The Client shall indemnify and hold harmless The House Plan Source against any claims, damages, or liabilities arising from third-party misuse of the Plans. The client remains the primary licensee and may not transfer or delegate license rights to third parties without express written consent.

7.2 Permitting, Compliance, and Professional Review Requirements

A. The Client expressly understands and agrees that all Plans provided by The House Plan Source are conceptual in nature and may require professional adaptation to: (i) meet specific local building codes, zoning ordinances, and jurisdictional requirements; (ii) comply with regional climate considerations, environmental regulations, and site-specific conditions; (iii) satisfy structural engineering standards, load-bearing calculations, and seismic or wind resistance requirements; and (iv) adhere to current accessibility guidelines, fire safety regulations, and all applicable construction standards, with the Client bearing sole responsibility for ensuring full compliance through engagement of qualified professionals prior to and during construction.
B. The Client expressly acknowledges and agrees that it is their sole responsibility to: (i) engage qualified architects, engineers, and other professionals to review and modify the Plans as necessary; (ii) obtain all required building permits, zoning approvals, and other necessary authorizations from local governing authorities; (iii) ensure all final construction documents and the completed structure comply with applicable building codes, laws, and regulations; and (iv) verify all site-specific conditions including but not limited to soil composition and geotechnical requirements, seismic and wind load considerations, energy efficiency standards, and fire safety regulations prior to and during construction.
C. The Client expressly acknowledges that The House Plan Source makes no representations, warranties, or guarantees whatsoever regarding: (i) the structural integrity, stability, or safety of any Plan; (ii) compliance with any specific jurisdiction’s building codes, zoning laws, or regulatory requirements; (iii) suitability for any particular geographic location, site conditions, or environmental factors; or (iv) the accuracy, completeness, or reliability of any dimensions, specifications, material requirements, or other technical details contained in the Plans, all of which remain the Client’s sole responsibility to verify and confirm through professional review prior to construction.

7.3 Construction and Implementation Responsibilities

The Client/User agrees to:

A. Assume all risks associated with the construction process B. Conduct regular inspections during construction to verify compliance with approved Plans
C. Immediately address any discrepancies between the Plans and actual construction
D. Maintain proper documentation of all modifications made to the original Plans
E. Not hold The House Plan Source liable for:
I. Construction defects or deficiencies
II. Cost overruns or project delays
III. Professional errors or omissions by third parties
IV. Failure to obtain necessary permits or approvals

7.4 Ongoing Compliance and Record Keeping

The Client expressly agrees to: (i) maintain complete and accurate records of all Plan modifications, engineering certifications, and professional approvals throughout the design and construction process; (ii) provide full documentation demonstrating compliance with these Terms upon reasonable request by The House Plan Source; (iii) provide written notification to The House Plan Source prior to implementing any substantial modifications that alter the fundamental design intent or architectural character of the original Plans; and (iv) ensure that all constructed elements strictly conform to either the licensed Plans as originally provided or to their professionally approved and properly documented modifications, with any deviations constituting a breach of these Terms.

8. PROHIBITED USES AND GENERAL RESTRICTIONS

The Client expressly agrees not to engage in, attempt, or facilitate any of the following prohibited activities with respect to The House Plan Source’s website, content, or intellectual property:

8.1 Technical Manipulation & Reverse Engineering

A. Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, architectural framework, or design methodologies of any Plans
B. Create derivative works, adaptations, or modified versions through any means of technical analysis or reconstruction
C. Use any software, tools, or processes designed to extract, scrape, or systematically reproduce the Plans or website content

8.2 Unlawful & Non-Compliant Usage

A. Utilize the Plans for any purpose that violates applicable federal, state/provincial, or local laws, ordinances, or regulations
B. Employ the Plans in connection with any unlawful activity, fraudulent scheme, or deceptive practice
C. Construct buildings that fail to meet or violate established building codes, zoning laws, safety standards, or environmental regulations
D. Use the Plans in jurisdictions where such use would require professional licensure that the Client does not possess

8.3 Automated Access & System Interference

A. Employ any bots, crawlers, scrapers, spiders, or other automated systems to access, monitor, or copy website content
B. Implement any processes that send excessive requests, impose unreasonable loads, or disrupt website operations
C. Circumvent any technological protection measures or security features implemented on the website
D. Engage in any activity that could damage, disable, overburden, or impair the website’s functionality

8.4 Intellectual Property Violations

A. Remove, alter, obscure, or falsify any copyright notices, watermarks, or proprietary markings
B. Claim ownership, authorship, or creative rights to any Plans or website content
C. Register trademarks, copyrights, or other IP protections based on or derived from the Plans
D. Use company names, logos, or marks in ways that suggest endorsement, affiliation, or sponsorship without express written permission

8.5 Commercial Exploitation & Distribution

A. Resell, redistribute, license, sublicense, or otherwise transfer the Plans to third parties
B. Post, share, or make available the Plans on file-sharing platforms, torrent sites, or public repositories
C. Use the Plans for speculative development, volume building, or commercial ventures beyond the licensed single-dwelling scope
D. Create stock plans, plan books, or derivative products for commercial sale or distribution

8.6 Consequences of Violations

Violation of these prohibitions constitutes breach of trust resulting in immediate termination of all license rights without refund as well as potential civil and criminal liability under copyright and intellectual property laws. We may also claim liability for damages including lost profits, statutory damages, and legal fees.

9. PURCHASES, PAYMENT TERMS AND ORDER FULFILLMENT

9.1 Pricing Structure & Currency

All Plan prices displayed on The House Plan Source website are quoted in United States Dollars (USD) and are subject to change without prior notice. We reserve the right to:

A. Modify pricing at any time due to market conditions, material costs, or business requirements
B. Correct pricing errors that may occur inadvertently in product listings or during checkout
C. Offer promotional discounts or limited-time pricing at its sole discretion
D. Adjust prices for customized modifications or special requests

9.2 Accepted Payment Methods

Clients may complete purchases using the following secure payment options:

A. Credit/Debit Cards: Visa, Mastercard, American Express, Discover
B. Digital Wallets: PayPal, Apple Pay, Google Pay

All transactions are processed through PCI-DSS compliant payment gateways with 256-bit SSL encryption. The House Plan Source does not store raw credit card information on its servers.

9.4 Digital Delivery Protocol

A. Instant Access PDF and CAD files become available immediately upon payment verification
B. Technical Requirements Ensure compatible software (e.g., Adobe Reader, AutoCAD) before purchase

9.5 Order Verification & Fraud Prevention

We reserve the right to:

A. Place orders on temporary hold for manual fraud review
B. Request additional identification for high-value transactions
C. Cancel orders suspected of fraudulent activity without notice
D. Limit purchase quantities to prevent commercial resale

9.6 Order Modifications & Cancellations

A. Pre-Fulfillment: Requests considered within 1 hour of purchase
B. Post-Fulfillment: Digital orders cannot be canceled after download access is granted
C. Order Errors: Contact support within 24 hours for assistance with mistaken purchases

9.7 Payment Security & Disputes

A. Chargeback Policy Unauthorized disputes may result in account termination and collection efforts
B. Declined Payments System automatically retries once; subsequent failures require new checkout

10. TAXES

You are responsible for all sales taxes, VAT, or duties applicable to your purchase. Tax amounts are calculated at checkout where required by law.

11. REFUND POLICY

11.1. Digital Products

The Client acknowledges and agrees that due to the intangible nature of digital goods and the immediate access granted upon purchase, all sales of Plans and digital products from The House Plan Source are considered final and non-refundable, except in cases where the purchased materials are proven to be materially defective, incomplete, or substantially nonconforming to their described specifications; in such exceptional circumstances, refund requests must be submitted in writing within seven (7) calendar days of the original purchase date, accompanied by detailed documentation clearly demonstrating the nature of the defect and how it renders the Plans unusable for their intended purpose, with the understanding that The House Plan Source reserves the sole right to evaluate the validity of such claims and determine the appropriate resolution, which may include, at the Company’s discretion, either issuing a full or partial refund or providing corrected replacement files, while expressly noting that any attempt to circumvent this policy through unauthorized chargebacks, credit card disputes, or other payment reversal methods will result in immediate termination of the Client’s account, revocation of all licensed materials, and may lead to further collection actions or legal proceedings to recover the disputed amounts plus associated administrative fees.

11.2. Refund Requests

Contact us within 7 days of purchase with details. Unauthorized chargebacks may result in account termination.

12. DISCLAIMER OF WARRANTIES

Plans are provided “as is.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, or compliance with local codes. You must verify Plan suitability with architects, engineers, or local authorities

13. LIMITATION OF LIABILITY

We are not liable for, indirect, incidental, or consequential damages (e.g., construction delays, costs), damages exceeding the amount paid for the Plan and errors or omissions in Plan content.

14. INDEMNIFICATION

You agree to indemnify us against claims arising from, your misuse of Plans, breach of these Terms and violation of third-party rights (e.g., unauthorized modifications).

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of United States of America excluding conflict of laws principles.
Disputes will be resolved in courts located in the state of Iowa

16. DISPUTE RESOLUTION

16.1. Negotiation

Clients agree to negotiate disputes in good faith for 30 days.

16. Arbitration

Unresolved disputes will be settled by binding arbitration under American Arbitration Rules in the state of Iowa.

17. MISCELLANEOUS

18.1. Severability

If a provision is invalid, the remainder of the Terms remains enforceable.

18.2. Entire Agreement

These Terms supersede prior agreements.

18.3. Force Majeure

We are not liable for delays due to events beyond our control.
