The House PlanSource (“website”) and its operators, affiliates, and licensors (collectively, “we,”
“us,” or “our”) provide digital house plans, CAD files, blueprints, and related content (“Plans”) to
the Clients (“Client”, “you”, “user”) and by accessing or using the website, you expressly
acknowledge and agree that all Plans are provided on an “as-is” and “as-available” basis without
any representations, warranties, or guarantees of any kind, whether express or implied,
including but not limited to any warranties of accuracy, completeness, merchantability, fitness
for a particular purpose, safety, or compliance with local building codes, zoning laws,
regulations, or industry standards, and you alone assume full responsibility and all associated
risks for verifying the suitability, safety, structural integrity, and legal compliance of any Plans for
your specific project requirements, geographic location, site conditions, and intended use, while
we expressly disclaim any and all liability for damages, injuries, losses, construction defects,
structural failures, code violations, or other consequences arising from or related to the use of
Plans, including those resulting from errors, omissions, inaccuracies, dimensional discrepancies,
material specifications, design flaws, or any unauthorized modifications, misuse,
misinterpretation, or improper implementation by you, your contractors, or any third parties.
The Client expressly understands and agrees that all Plans provided by The House Plan Source
represent conceptual design documents only and in no way constitute professional
architectural, engineering, or construction services, nor do they replace or supersede the need
for qualified professional review and adaptation, and the Client bears sole and complete
responsibility for: (a) engaging properly licensed architects, structural engineers, and other
construction professionals to thoroughly examine, modify as necessary, and formally approve all
Plans prior to and during construction; (b) securing all legally required building permits, zoning
approvals, inspections, and other regulatory authorizations from the appropriate local governing
authorities having jurisdiction over the project; and (c) verifying full compliance with all
applicable building codes, zoning ordinances, environmental regulations, accessibility standards,
and other legal requirements specific to the project location, as the Plans may not account for or
comply with such jurisdictional variations and meeting these requirements remains exclusively
the Client’s obligation throughout all project phases from design through final construction.
o the fullest extent permitted by applicable law, The House Plan Source, its affiliates, licensors,
and service providers shall not be liable for any direct, indirect, incidental, special,
consequential, exemplary, or punitive damages of any kind whatsoever (including but not
limited to construction delays, cost overruns, property damage, personal injury, or wrongful
death) arising from or related to the use of our website or Plans, nor for any loss of profits,
revenue, data, business opportunities, or goodwill, regardless of whether such damages were
foreseeable or whether we were advised of their possibility, and this limitation applies to all
claims whether based on warranty, contract, tort (including negligence), strict liability, or any
other legal theory, including but not limited to claims arising from third-party actions or
omissions (such as those of contractors, subcontractors, material suppliers, or regulatory authorities), with our total aggregate liability for any and all claims relating to the Plans or
website use being strictly limited to the total purchase price actually paid by you for the specific
Plan(s) giving rise to the claim, and in no event shall our liability exceed this amount, with some
jurisdictions not allowing certain limitations of liability so this limitation may not apply to you to
the extent prohibited by law.
All Plans, designs, content, and intellectual property displayed on or accessible through The
House Plan Source website, including but not limited to architectural drawings, CAD files, 3D
renderings, text descriptions, and graphic elements, are and shall remain the exclusive property
of The House Plan Source and/or its licensors, protected under applicable copyright, trademark,
trade dress, and other intellectual property laws, both domestically and internationally, with the
purchase of any Plan granting the Client only a limited, non-exclusive, non-transferable,
revocable license strictly for the construction of one (1) single-family dwelling on a single
specified property, which license expressly prohibits any form of resale, redistribution, or
sharing of the Plans in either digital or physical formats, the creation of derivative works,
modifications, or replicas without The House Plan Source’s prior written consent, and any
commercial application including but not limited to speculative building, multi-unit
developments, or volume construction projects without obtaining an extended commercial
license through separate written agreement, with all rights not expressly granted herein being
reserved exclusively by The House Plan Source.
While The House Plan Source makes its digital house plans and design services available for purchase worldwide, please be advised that all structural
specifications, building techniques,
material requirements, and dimensional standards incorporated in our Plans are designed to
comply with United States building codes, regulations, and construction practices.
By purchasing and downloading any Plans, you expressly acknowledge and agree that:
A. Non-Applicability to Other Regions
Our Plans may not meet the structural, seismic, climatic, or regulatory requirements of
your specific country, state, or municipality outside the U.S.
B. Professional Review Required
It is your sole responsibility to consult local architects, engineers, and building
authorities to determine whether modifications are necessary for compliance with regional standards before construction.
C. No Refunds for Regional Non-Compliance
Since Plans are provided as digital downloads, all sales are final. No refunds will be issued based on incompatibility with non-U.S. building codes, zoning laws, or regional construction norms.
D. Assumption of Risk
By proceeding with the purchase, you accept full liability for ensuring the Plans’ suitability for your location and absolve The House Plan Source of any responsibility for
non-compliance outside the U.S.
For projects outside the United States, we strongly recommend engaging a local structural
engineer to review and adapt the Plans prior to use
The website may contain links to third-party websites, tools, or services. We do not endorse, control, or assume responsibility for the accuracy, legality, or safety of third-party content. We
do hereby disclaim liability for damages arising from your use of third-party resources.
The Client hereby agree to fully defend, indemnify, and hold harmless The House Plan Source, its
parent company, subsidiaries, affiliates, officers, directors, employees, contractors, licensors,
and agents from and against any and all claims, demands, liabilities, damages, losses, costs,
expenses (including reasonable attorneys’ fees and court costs), fines, penalties, or other
charges of any kind whatsoever arising from or related to: (i) the Client’s breach or alleged
breach of these Terms of Service or any applicable laws or regulations; (ii) the Client’s
unauthorized use, reproduction, modification, distribution, or misuse of any Plans or related
materials; (iii) any unauthorized alterations, adaptations, or derivative works created from the
Plans without The House Plan Source’s express written consent; (iv) the Client’s failure to
comply with any applicable building codes, zoning ordinances, construction standards, or safety
regulations in any jurisdiction; (v) any infringement or alleged infringement of third-party
intellectual property rights (including but not limited to copyright, trademark, or patent claims)
resulting from the Client’s use or modification of the Plans; (vi) any personal injury, property
damage, or construction defects arising from or related to the implementation of the Plans; and
(vii) any other acts, errors, or omissions by the Client, its agents, contractors, or representatives
in connection with the use of the Plans, with this indemnification obligation surviving
termination of these Terms and remaining in full force and effect regardless of the cause of
action or theory of liability asserted.
These disclaimer statements as well as any other terms and policies available on or through our
website are governed by the laws of Iowa, USA], excluding conflict of laws principles. Any
disputes shall be resolved exclusively in the courts of [Jurisdiction], and you consent to personal
